The issue
We're catching them red-handed.
The violation
Under CEO Carol Tomé, UPS is destroying good jobs and customer service. Teamsters Local 804 members work at UPS across metro New York – and we are fighting back.
UPS is laying off clerks and instead, having supervisors and low-wage part-timers tape up and repair damaged boxes. This is an attack on good jobs that pay living wages – and it is a violation of our union contract.
UPS has already been BUSTED for this violation. An arbitrator ordered UPS to pay financial penalties for violating the contract and ripping off employees.
The arbitrator ruled that tape-up work must only be done by a clerk and ordered UPS to cease and desist from violating the contract. The only exception is if a flap of a box needs to be taped down.
UPS is flagrantly violating this order.
We've launched the UPS Busted campaign to document these violations and gather the evidence we need to enforce the arbitrator's order
The Company shall immediately cease-and-desist from using non-clerks who are not DNP-certified [sic] from performing more extensive tape ups, i.e., those beyond taping flaps and seams, and any types of repacks, rewraps, etc.

How you can help bust UPS
Film it
Take a short video or photo of anyone doing clerk work who is not a clerk. You have the right under federal law to video or photograph a contract violation. Videos should be one minute or less.
- Get the package in frame
- Get the person doing the work in frame
- Say the building and the date out loud
- Keep it under a minute
- Only take videos and or photos while you are off the clock
Report it
Report the violation to UPS Busted. All you need to do is upload your video or photo and fill out the form with the basic information: where the violation happened, when, what supervisor did the work or instructed a non-clerk to do the work, who witnessed the violation, etc.
Take union action and win
Reported violations will be reviewed by Local 804's contract enforcement and legal team. Local 804 has the right to strike or go to court over UPS violating the arbitration decision. All options are on the table. We're gathering the iron-clad evidence to win.
